Those who followed the case of former Butaleja District Woman MP Cerinah Nebanda remember Dr. Sylvester Onzivua. He was arrested as he attempted to fly the samples taken from Nebanda’s body after the then 24-year-old legislator died at Nsambya Hospital.
Nebanda died in 2012 and now Dr Onzivua has come out to expose the Directorate of Government Analytical Laboratory (DGAL) for what he believes could be deliberate cover-up masked as incompetence to arrive at the heart of the matter in high profile poisoning and murder cases.
The Maj Gen (Rtd) Kahinda Otafiire-led Ministry of Internal Affairs is pushing for the Forensic Evidence Bill 2024 that could see the DNA profiles of suspected and convicted criminals stored by the state.
Appearing before Parliament’s Defence and Internal Affairs Committee to give his opinion on the Forensic Evidence Bill 2024, Dr Sylvester Onzivua talked of cases when he believes that the Directorate of Government Analytical Laboratory did not do the right thing.
Pathologist Onzivua said that mistakes by DGAL had made courts of law condemn suspects to long custodial sentences. Remember the case of Robinah Kiyingi and the mysterious death of key suspect named Atwine?
“We had a lawyer called Robina Kiyingi who was shot and during the investigations, the Police did their best and they actually got the guy who pulled the trigger, a man called Private Atwine and was taken to Luzira. But Atwine died very mysteriously,” Onzivua told MPs.
“We did a postmortem, we got his samples and took them to DGAL, DGAL said we couldn’t detect any poison. We said no, this sample must go to South Africa, when they got to South Africa, they got a medical drug called Lidocaine which was given to this guy intravenously and that medicine causes your heart to stop.”
Consequently, some have opted for South African and other foreign laboratories since they doubt sample results given by DGAL. The pathologist further noted that the DGAL Director had told him that the inconsistences in the Atwine case could have been due to incompetence at the government laboratory.
“I went to the Director of DGAL and this South African laboratory detected this poison but you people failed to detect, so I asked him, ‘were you people compromised or were you incompetent’ and he admitted to me saying he thinks it is incompetence. And I said, ‘why the incompetence?’ and he said they didn’t analyze all the samples, they analyzed some.”
With lessons from the handling of such cases, Onzivua would not trust the Nabanda samples investigation with the DGAL. “In fact, that was one of the things that motivated me to take Nebanda’s samples to South Africa, although we left some of them here, but I said, ‘this incompetence, I will not be part of it’,” he further noted.
There was another case where the young man died at Nsambya Hospital, the hospital clearly said this is pancreatitis. These guys go and exhume the body, send the samples to DGAL, DGAL says, we have found this poison. It could never have been and somebody was sent to 40 years in jail.
They said ‘this was acute poisoning yet the evidence was, this guy is alleged to have been poisoned in March, then he died in May. Poisoning? What kind of poisoning and they said it was first killing poisoning, yet it was administered in March,” he further narrated.
It is the same laboratory that releases DNA test results.
